Totally agree with that but the Imm said that path = cabal grounds and that someone on the path should be treated as if they were at the guardian.

It works for most classes. What if you're a ranger? You bring your pets and you flee, you spend the next 10 tries trying to get your pets together out of the cabal. If you path sit, he doesn't defend. If you invade inside, you have a hard time with your pets.
If you invade without pets, run out get your pets and enter the path and sit there, they aren't oblidged to defend? Then they can just quit if they want to even though you're on the path?
If you're forcing the other guy to come to you and he has nothing he can do, chances are you're higher levelled or just better geared or just better skilled, whatever the case you're choosing to press the fight. If you go that far the least you can do it just touch the guardian once to really bind them into obligation to come. There are some nice things about that not only losing your pets, but losing hp flee'ing in and out, and carrying and swapping saves gear even if for just a minute so you don't get cursed and dispelled. That minor damage/annoyance you just took is a nice tradeoff to force them to come.
On the flipside again if you're like a Rigwarl you're supposed to just go and you certainly don't need the other guy trading off that health to make you go, you just go or even better find the other guy before he can even sit on your path.
